The Mecklenburg County Courthouse may be where your divorce disputes are litigated if at least one of the spouses live in Mecklenburg County.[1] Like most North Carolina courts, the Mecklenburg courthouse has a lot of rules, deadlines, forms, and procedures that are specific to that courthouse. This courthouse's local rules and forms can be found [OCR.pdf here]. However, most spouses will not end up using all 130 forms or need to read all 35 pages of [OCR.pdf the family court rules]. This wiki will summarize the rules and forms are applicable to a large number of Mecklenburg cases.
How to Schedule a Hearing
- File a motion or pleading with the court
- Request a date from the Family Court Administrator (FCA) with a copy of the filed motion or pleading
- Prepare a Notice of Hearing (Form CCLF-FC-003) to serve on the spouse and give to the FCA
Financial Disclosures
Financial Disclosures refers to a set of documents, records, and information you are required to provide to your spouse. Each county courthouse has different forms and requirements for financial information you have to disclose.
- Equitable Distribution:Affidavit of Equitable Distribution (Form CCF-33) must be completed and served 10 days before the initial pretrial discovery conference (IPTC). See rule 13.3 for required documents/records and other attachments.
