A Summons is a document served on the spouse with the initial lawsuit filings. It is mandatory in all lawsuits. It serves as a formal notice the person is being sued and has 30 days to respond. In almost all cases, you would use the standard form: Form AOC-CV-100. You only need to complete the top half of the first page. The court clerk completes the bottom half of the first page. If you serve by sheriff, the sheriff completes the second page.
