Mediation is a negotiation method that both spouses are required to participate in for most divorce-related lawsuits. In mediation, ordinarily each spouse is in a separate conference room. A mediator shares settlement offers and counteroffers between the spouses. The mediator coaches each spouse to make compromises and see things from their spouse's perspective. Mediators and mediation are very effective at resolving marital disputes without trial. Upon a motion by one or both spouses, the court can waive the requirement for mediation or allow another format of alternative dispute resolution. These include a judicial settlement conference, which avoids the cost of a mediator, or arbitration. However, mediation is recommended in most cases.
